So what happens if you refuse the breathalyzer? Do you automatically get the stiffer penalty? In NY it’s an automatic license revocation for one year and a $500 for a first offender. If charged with DWI and later acquitted the revocation remains. If you take the charge to trial, refusal of a breathalyzer or chemical test can be entered into evidence and argued that the refusal was an admission of guilt.

^^^It is basically an admission of guilt anyway. Over here, you don't refuse until you're drunken. Once a driver of the firm I've worked got caught, ran away from the policemen, into his house, grabbed a bottle of wodka and drank. That's how the police found him. His argument was "now they can't prove I was drunken before". Too bad that on top of drunk driving, he got in trouble for running from the police, too and on top of that, since the policemen had thought that he was grabbing a weapon, he actually was in big legal trouble. He got fired the very next day, since my boss didn't want to be associated with such a dumb, drunk asshole - because he' bragged about being so clever.

We have a mandatory license suspension with a refusal even if you’re not guilty but the suspension is tied to the refusal itself.

Same for NY, the revocation falls to the DMV as part of your “contract” for the privilege of driving. You can fight it in the DMV hearing that is mandatory post DUI arrest. The admin judge looks only at the refusal- was there are refusal and if so it’s automatic one year revocation. You can fight that with an appeal. For some, it is restored but only for their working hours if they can provide sufficient proof they need to drive to get to work or for work.

You can only have a driver's license in your home state and if it is revoked you can't drive anywhere in the US. I supposed you can still have an international license.
